Procedure - Resolution of Staff Complaints
Purpose
This procedure is established to provide a clear, orderly process for the resolution of staff complaints as outlined in Board Policy 5270.
Step One: Immediate Supervisor
- The staff member must present a written complaint to their immediate supervisor within 15 calendar days of the action or incident that gave rise to the complaint. If the immediate supervisor is the subject of the complaint, the staff member should direct their written complaint to the Human Resources Director or designee.
- The written statement of the complaint must contain:
- The facts as the staff member sees them;
- A reference to the district policy(ies) or procedure(s) allegedly violated;
- The remedies sought.
- If a written complaint is not submitted within the specified timeline it may result in waiver of the complaint. If the immediate supervisor chooses to waive a complaint due to the expired timeline, the immediate supervisor will provide in writing the reason for the waiver:
- Remedies sought are unreasonable under the expired timeline; or
- Remedies sought are moot given the expired timeline.
- Upon receipt, the immediate supervisor will meet with the staff member.
- If the complaint involves another staff member or administrator the individual may also share their perspective at another meeting.
- Within 10 calendar days of the meeting the supervisor will provide the staff member a written response.
- If the complainant does not file a written appeal with the superintendent/designee writing within 10 calendar days following the supervisors written response the complaint will be considered waived.
Step Two: Superintendent/Designee
- The superintendent/designee will, within 10 calendar days of receiving the written appeal, meet with the complainant to hear the claim.
- If the complaint involves another staff member or administrator that individual may also share their perspective at a separate meeting.
- The superintendent/designee will issue a written decision within 10 calendar days of the meeting.
- If the complainant does not submit a written appeal the board of directors (through the superintendent/designee) within 10 calendar days of receiving the decision, the complaint will be considered waived.
Step Three: Board of Directors
- If the complainant appeals to the board, the board will hold a hearing to review the complaint. The complainant may be accompanied by counsel.
- If the complaint involves another staff member or administrators they may be present to provide information.
- The board will issue a written decision within 15 calendar days of the hearing. The board's decision is final.
