Procedure - Lummi Education Advisory Council

The Lummi Indian Tribe and Ferndale School District agree that a mutual goal is to provide the best education possible for all children. Further, the Tribe and District agree that mutually developed and/or cooperative programs must take into consideration the needs of the District and the needs of the Tribe. To assist in the attainment of these mutual purposes, an Education Advisory Council has been established to provide a vehicle for communication between the Tribe and the District in areas of mutual concern.

I. Name

The name of the council is the Lummi Indian Tribe -- Ferndale School District Education Advisory Council, hereafter referred to as the L/DEAC.

II. Objectives

The objectives of the L/DEAC shall include:

  1. To serve in an advisory capacity to the District administration and Lummi Superintendent of Education regarding the planning and coordination of Indian education programs.
  2. To study Indian Education Program proposals in relation to identified education needs.
  3. To provide suggestions concerning compensatory programs designed to meet the needs of Indian children.
  4. To periodically review programs and activities available within the District and the Tribe.
  5. To coordinate, advise, and recommend in areas of joint interest.
  6. To monitor, develop, and implement the Lummi Indian Tribe -- Ferndale School District goals and objectives.
  7. Plan and conduct involvement activities pertaining to Ferndale School District's federal impact aid (P.L. 81-874). The related administrative procedures (4220 P-3) outline these activities.

III. Basic Policies 

  1. The L/DEAC shall be non-political, non-commercial, and non-sectarian.
  2. The L/DEAC shall serve as an advisory body -- not a decision making body.
  3. The L/DEAC shall support the improvement of education taking into consideration the needs of the District and the needs of the Tribe.
  4. The L/DEAC shall work within the administrative structure of the District and Tribe and, keeping in mind the advisory responsibility, shall not seek to control or establish policies for either.
  5. The L/DEAC shall recognize that its functions are not to usurp the authority of the Tribe, parent advisory committees, and/or school district; it is instead a vehicle to complement the functions of these various agents.
  6. The L/DEAC will utilize the information gathered in meetings related to federal impact aid when planning future programs.

IV. Membership

  1. The L/DEAC shall consist of up to eight persons with equal representation from the Tribe and District.
  2. The Ferndale School District superintendent, or his/her delegated representative, shall appoint and replace the District representatives. The Lummi Superintendent of Education shall appoint and replace the Lummi representatives with approval of the Lummi Education Commission/LIBC.
  3. It is strongly recommended that representatives hold leadership roles in educational programs.
  4. Further, it is recommended that one district representative have district- wide responsibilities and one Tribal representative have similar responsibilities with the Tribe.
  5. It is strongly recommended that consideration to continuity be given when representative are appointed and/or replaced.

V. Co-Chairperson(s)

  1. The L/DEAC shall select co-chairpersons.
  2. The co-chairpersons shall be appointed in September and will serve for one calendar year.

VI. Duties of Chairperson

  1. Co-chairpersons

a. The co-chairpersons shall be charged with the responsibility for providing leadership for the L/DEAC.

b. The co-chairpersons shall take the responsibility to ensure that adequate records, correspondence and other documentation are distributed and maintained.

c. The co-chairpersons shall ensure that an annual report is submitted upon request to the Ferndale School District Board of Education and the Lummi Educational Commission/Lummi Tribal Council regarding a summary of its activities.

VII. Meetings

1. Regular L/DEAC meetings shall be held approximately four times per year; and, additional meetings will be called as needed.
